Restraining Orders and Injunctions

Kerstein, Coren & Lichtenstein can assist you if you need to obtain a restraining order or injunction in an emergency situation. Our attorneys represent clients being physically abused or at risk of being physically abused. We help the victim or potential victim to obtain a restraining order and prevent abuse. Our firm also obtains restraining orders or injunctions for clients who are being prevented from doing something they are legally entitled to do, such as attend school or build a house, or clients who want to prevent someone from doing something they are not legally entitled to do.

There are several types of court orders, and they have various effects. A restraining order is an order from the court that mandates that the abuser is not allowed to hurt you or attempt to hurt you, nor threaten you. A vacate order mandates the abuser is ordered to leave the residence. This may be ordered even if the abuser owns or pays rent for the residence. If you are a parent, the court may order that you have temporary custody of any minor children remaining in your care. If you are married, the court can order the abusive spouse to pay living expenses. A money compensation order stipulates that you be compensated for expenses resulting from the abuse, such as medical expenses or lost wages. There are also other types of injunctions such as an injunction that the abuser have no contact with you, return your house keys, etc. These can be stipulated in the court order.

  • Abuse Prevention Orders

If you obtain a restraining order or other court order or injunction, the police department will serve the abuser with the order. Any information you can provide to the police department to help them locate the abuser will expedite this process.
