School Discipline and Student Rights

The Education Law attorneys at Kerstein, Coren & Lichtenstein assist students of all ages in the area of school discipline, including suspensions, expulsions, and violations of student rights. We have successfully represented those who have been wrongfully expelled, excluded, or dismissed from their schools or colleges, as well as those who wish to challenge a suspension or other disciplinary action. We are passionate about and dedicated to assisting students and their families attain their educational goals.

Students and families often try to defend themselves or negotiate with school districts, private schools, colleges, or universities without fully understanding the laws and rights available to them. For example, if a student is suspended or expelled from school or facing other disciplinary action, the student has the right to a fair hearing. At this point, students and families should hire an attorney who concentrates in Education Law in order to ensure the student is adequately represented. We are available to negotiate with schools and advocate for you or your child. If necessary, we are available to assist and/or represent you or your child at administrative or school hearings, as well as due process hearings or generally within the court system.

In many types of cases, including those dealing with disciplinary actions, students are prohibited from bringing an attorney to the hearing. If you are in that situation, you still may benefit from working with one of the KCL attorneys to help you prepare for the hearing by reviewing documents, discussing the issue, and advising you once a decision is made.
