SAME SEX MARRIAGES

Marriage between persons of the same sex is lawful in Massachusetts and provides the same expectations regarding the benefits and obligations of marriage under state law. However, anyone entering into a same sex marriage, or looking to obtain a divorce from a same sex spouse should be aware that the Defense of Marriage Act (DOMA) places Federal law in conflict with Massachusetts law in some situations. 

Same sex marriages may entail legal issues such as separation, divorce, asset division and spousal support.  Our family law attorneys have extensive experience dealing with marital rights and obligations in same sex marriages.

If there are children involved, through adoption or surrogacy, in a same sex relationship a separation or divorce proceeding may also involve issues such as custody, visitation, support, health insurance and higher education.
