Some marriages or dating relationships unfortunately involve physical and/or emotional abuse. Kerstein, Coren & Lichtenstein is experienced with helping clients prosecute or defend against domestic violence claims, also referred to in Massachusetts as “209A complaints.”

If you are a victim of abuse from your spouse or significant other, we will seek to obtain a restraining order against the person who is abusing you. If children are exposed to such abuse, a restraining order may include an order prohibiting the offending party from contact with the children.

The Massachusetts abuse law prohibits abuse if it consists of: (a) attempting to cause or causing physical harm, (b) placing another in fear of imminent serious physical harm; or (c) causing another to engage involuntarily in sexual relations by force, threat, or duress.  Abuse complaints may be brought by a spouse or by anyone who has been in a dating or engagement relationship.

Unfortunately, some persons may falsely accuse a spouse or significant other of committing abuse, sometimes to gain leverage in a divorce proceeding.  We have extensive experience and have successfully defended clients against such false accusations.  If a restraining order has been brought against you, it is important that you seek representation for the hearing.
